The Fast 800 – App Subscription Terms & Conditions
These terms and conditions apply to The Fast 800 App subscription (“the App subscription”) offered by The Fast 800 (“we”, “us”, “our”). Please read them carefully as they affect your rights and liabilities under the law and set out the terms under which we make the App subscription available to you. These terms will be subject to any rights you may have under consumer law to which we are bound and which cannot be waived by contract.
By taking out the App subscription, you agree to comply with these terms and conditions and the App Membership Terms & Conditions which apply to the use of our digital services generally as it may be accessed on various internet-connected devices (such as smartphones and tablets). We recommend that you print a copy of these terms and conditions or save a copy for future reference.
As you’ve taken out the App subscription through a third party app store provider (e.g. Apple or Google), the terms and conditions of the relevant app store provider will also apply to the App subscription. We recommend that you read these terms carefully. If there is any conflict between these terms and the terms of the app store provider, the app store provider’s terms will apply only in relation to the App subscription (including your cancellation and refund rights).
1. What is an App subscription?
The Fast 800 App (“the App”) contains features only available with a paid for subscription.

We can change the benefits of the App subscription from time to time as set out in section 4 (Changes to the App subscription).
You can start enjoying your App subscription by signing in, using the details associated with your The Fast 800 account, after you have successfully registered for the app store subscription.

2. How can I take out an App subscription?
You can take out an App subscription by downloading the App and subscribing within the App. You will need to have the minimum latest device requirements (as described in the App description on third party app stores from time to time), be connected to the Internet and be authorised to make an in app purchase.
From time to time, we may release updates to the App and we recommend that you download these updates to get the best experience from the App.
As part of the process, you will need to register for a The Fast 800 account, if you do not already have one.
You will then be required to sign in, using your The Fast 800 account details, within the App in order to start enjoying the benefits of your App subscription.
Your subscription is personal to you and non-transferable.
Your order for an App subscription is an offer to purchase a subscription from us which, when accepted, will then constitute a binding contract. Nothing that we do or say will amount to any acceptance of that offer until we or the app store providers send you confirmation of your order by email.
We will not be responsible for any failure by you to receive such confirmation which results from your failure to supply us, or the app store providers, with correct contact details or which results from any delay or failure by our third party app store providers to send you the confirmation email.
We, and our third party app store providers, will assume that all information provided as part of your order is correct and we will both process your order accordingly.
We reserve the right to reject any order for an App subscription without giving a reason. Our third party app store providers may also separately reject any order for an App subscription and this will be beyond our control. We will not be liable to you for your loss of access if this happens.
3. Subscription Period and Renewals
You can subscribe to the App on a monthly, 3 monthly or annual basis. Your App subscription will start immediately on commencement of your free trial. If you have previously taken advantage of the free trial, your payment will be taken immediately.
Once your App subscription order has been accepted, your subscription will continue and renew automatically on a monthly, 3 monthly or annual basis until it is ended by you in accordance with section 7 (Cancellation) and auto-renew is turned off at least 24 hours before the end of the current monthly or annual period.
We and our third party app store providers may also cancel your subscription in accordance with section 7 (Cancellation).
You will continue to be charged the renewal fee each time your App subscription renews.
4. Changes to the App subscription

If we change the App subscription price and/or benefits and features, we will give you this advance notice so that you can choose whether or not to cancel your App subscription.
If you are unhappy with the changes, you will need to cancel your App subscription, before the changes take effect. If you don’t do so, you will only be able to cancel your App subscription in accordance with section 7 (Cancellation).
You will continue to receive your App subscription, until you cancel your subscription.
We can always change the App from time to time to implement technical adjustments, updates and/or improvements, for example to address security threats or remedy bugs. These are changes that do not affect your use of the App and so we will not give you prior notice and you are not able to cancel your App subscription due to these changes. You might be asked to reinstall the App, accept updates or log out and log back into your account.
We also reserve the right to suspend the App and the App subscription at any time. See section 9 (Suspension of the Live App) for more information.
You agree to pay the subscription price for the App subscription. The price and payment options will be shown during the subscription sign up process within the App and in your confirmation email. Subscription prices may vary from time to time and by country.
Each payment for the App subscription will be taken on a regular, rolling basis by the relevant app store provider (i.e. monthly payments are billed each month, 3 monthly payments are billed every 3 months, and annual payments are billed once a year). Your payments include any applicable sales taxes.
By paying for the App subscription through your app store provider, you agree to the relevant app store provider’s terms (including payment terms). We recommend that you read these terms carefully.
Your App subscription will continue unless and until it is ended by either of us, or the app store provider, in accordance with section 7 (Cancellation).
We reserve the right to introduce temporary offers and discounts from time to time, to enable users to enjoy an App subscription for a reduced cost or without charge. These promotional offers will be subject to their own terms, which will be published together with the relevant offer, and subject to availability. We reserve the right to offer and withdraw promotional offers at any time and in no way guarantee that a promotional offer will be available at any particular time.
If you choose to take out an App subscription as part of a promotion or discount, you will need to comply with the offer terms and will be charged the reduced price during the offer period. At the end of the offer period, your subscription will automatically continue on a rolling basis at the full subscription price.
(a) Your right to cancel
You can cancel your App subscription at any point by cancelling before your next subscription payment date and turning off auto-renew at least 24 hours before the end of the current monthly, 3 monthly or annual period.
To cancel your App subscription, you will need to follow the steps indicated by the relevant app store provider (for example Apple or Google).
The cancellation will take effect at the end of your current billing period. You will not receive your App subscription after this time. You will not receive any refund for cancelling your subscription.
If you do not cancel before your next payment date, your App subscription will automatically renew for another month, 3 months or year (as applicable), and you will need to cancel before the next payment date.
(b) Our right to cancel
We may cancel your App subscription immediately if you breach any of your main obligations under these terms and conditions, including if the App store provider does not receive a payment when due from you. We will make reasonable efforts to contact you before your App subscription is cancelled in this way. If we cancel for this reason, you are not entitled to a refund.
We may also cancel your App subscription if we are unable to provide you with the App subscription. We will make reasonable efforts to contact you before your App subscription is cancelled in this way.
We may stop making available the App or providing you with the App subscription at any time by providing you with at least 30 days’ prior notice.
Finally, we may immediately stop providing you with the App subscription at any time if there are exceptional circumstances or circumstances beyond our reasonable control (such as the acts of Apple, Google or other third party app stores).
(c) Other rights to cancel
Our third party app store providers may end your App subscription, and this will be beyond our control. If this happens, we will try to work with you and our app store providers to understand what’s happened.
8. Suspension of the Live App
We may need to suspend the supply of the App and your App subscription at any particular time:
We will try to let you know in advance if we are suspending supply but this may not always be possible, for example if we need to suspend urgently or due to an emergency. Where we suspend supply, we will work hard to try and minimise the period of unavailability.
We will not be liable to you for any loss due to your loss of access if we suspend the supply of the App and your App subscription.
Our third party app store providers may also separately suspend the App and your App subscription, and this will be beyond our control. We will not be liable to you for your loss of access if this happens.
9. Our Responsibility To You
We shall not be responsible for any failure by us to perform our obligations where this failure is caused by circumstances beyond our control (such as the acts of our third party app store providers). Furthermore, we shall not be responsible for any failure to provide you with the App subscription if this is due to the supply of incorrect contact details by you or any other act committed by you.
Please note that issues with your mobile network operator and/or data connection with your device may mean that you are unable to access the App at any particular time – this is outside of our control and we shall not be responsible in these circumstances.
We exclude our liability to you to the maximum extent permitted by law.
In all other events, our total liability to you for all claims however arising in connection with your App subscription will not exceed twelve (12) times the monthly amount you pay.
Our exclusions of liability shall not apply to any damages arising from death or personal injury caused by our negligence or that of any of our employees or agents or any other liability which we cannot limit by law.
You may have statutory consumer rights that apply to your App subscription which cannot be limited, excluded or modified. Nothing in these terms and conditions limits, excludes or modifies any such consumer rights.

11. Changes to these terms and conditions
We may update these terms and conditions from time to time by providing you with at least 30 days’ prior notice of any material changes. The changes will apply to your App subscription at the end of the 30 days.
If you’re not happy with the new terms and conditions, you should not continue with your App subscription as this will indicate your agreement to the new terms and conditions.
If you do not wish to accept the new terms and conditions, you should cancel your App subscription within the 30 days’ notice period.
12. Corporate Information
The App and the App subscription are provided by Healthlab Online Limited, which is registered in England and Wales under company number 10616389 and has its registered office at 9 Thorney Leys Park, Witney, Oxfordshire, OX28 4GE. The Company’s VAT number is 307 7027 18.
Apple, Google and any other third party app store providers take and process orders and payments for your App subscription on our behalf.
We intend to rely on the written terms set out in these terms and conditions.
If a court invalidates some of these terms and conditions, or some of these terms and conditions become illegal or unlawful, the rest of these terms and conditions will continue to apply.
We can transfer these terms and conditions to another person at any time and we will give you reasonable prior notice if we plan to do this.
Nobody else has any rights under these terms and conditions – they are between you and us only.
Even if we delay in enforcing these terms and conditions, we can still enforce them later.
These terms and conditions are governed by English law. Despite where you live, you can bring a claim in respect of these terms and conditions in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
If you live outside of the UK, you remain entitled to any rights you may have under consumer law applicable in your country of residence.
